Right of Withdrawal for Consumers
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
Please note that the right of withdrawal applies only to customers residing in a member state of the European Union (EU). If you are located outside the EU, different return conditions may apply. For questions regarding your order or applicable return rights, please contact our customer service.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without providing any reason.
The withdrawal period is fourteen days from the day:
- on which you or a third party named by you, who is not the carrier, has taken possession of the goods, provided you have ordered one or more items as part of a single order and these are delivered together; or
- on which you or a third party named by you, who is not the carrier, has taken possession of the last item, provided you have ordered multiple goods as part of a single order and they are delivered separately; or
- on which you or a third party named by you, who is not the carrier, has taken possession of the last partial shipment or the last piece, provided you have ordered a product that is delivered in multiple shipments or pieces; or
- on which you or a third party named by you, who is not the carrier, has taken possession of the first item, provided you have concluded a contract for the regular delivery of goods over a fixed period.
To exercise your right of withdrawal, you must inform us (Smartboatia GmbH, Theaterplatz 2, 23909 Ratzeburg, Germany, Email: sales@smartboatia.com) by means of a clear statement (e.g., a letter sent by post or email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.
You may also electronically fill out and submit the sample withdrawal form or any other clear statement on our website at https://smartboatia.com/revocation/. If you use this option, we will promptly send you a confirmation of receipt of such withdrawal (e.g., via email).
To comply with the withdrawal period, it is sufficient that you send the notice of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a different type of delivery than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same payment method that you used in the original transaction unless explicitly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.
We may withhold the reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.
You will bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods if this loss in value results from handling the goods in a manner not necessary for checking their condition, properties, and functionality.
